Hassrede und Katzenbilder: Ausgewählte menschenrechtliche Aspekte der Governance von Meinungsäußerungen im Internet

Matthias C. Kettemann and Katharina Mosene describe in their contribution to the anthology "Hass im Netz - Grenzen digitaler Freiheit [Hate Online – Limits of Digital Freedom]" how effective the governance of freedom of expression on the Internet is in the fight against hate speech.
 

The struggle to protect freedom of expression on the Internet should actually take place on an agora. However, the spaces in which the governance of freedom of expression in digitality is being fought over are more like arenas. In private, hybrid and public spaces, which are characterized by different power relations between states, companies and users, a new type of governance of freedom of expression is being pursued algorithmically or by people, with reference to international law, European law, national basic and human rights as well as transnational normative arrangements such as standards. How effective this governance is in the fight against hate speech will be the central theme of this contribution, which approaches in several steps the combat zone, which is contoured by the title-giving concepts of hate speech and charming cat images that are socio- and individual-psychologically harmful and therefore legally to be fought against.
