Is there a "basic right to Internet access" in Germany?This question can be systematically answered with the help of a heuristic regulatory-scientific analysis framework that combines the levels of a model of providing technical information with the actual conditions for the individual use of technical communication systems and specifies them for the Internet as the object of observation.
In this way, Markus Oermann clarifies the differentiated constitutional structures of guaranteeing the possibility of Internet-based communication. He also points out gaps in the established protection concept and offers solutions for problems currently under discussion such as the treatment of intermediate services. Using illustrative examples, he illustrates the interactions between EU law, constitutional law and national legislation and develops perspectives for their future development.
